1. Acceptance of Terms

Welcome to LoveKeeper! By downloading, installing, or using the LoveKeeper mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree to these Terms, please don't use the App.

These Terms constitute a legally binding agreement between you ("User" or "you") and LoveKeeper ("we," "us," or "our").

2. Description of Service

LoveKeeper is a mobile application designed to help you:

• Track important dates like anniversaries, birthdays, and special occasions
• Store and organize memories with photos and descriptions
• Create and manage bucket list goals
• Receive reminders about upcoming events

The App is provided free of charge. Core features work offline; email reminders and account features require a connection and limited server storage.

3. User Eligibility

You must be at least 13 years old to use LoveKeeper. By using the App, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations

4. License to Use

4.1 Grant of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device(s) for your personal, non-commercial use.

4.2 Restrictions

You agree NOT to:

• Modify, reverse engineer, decompile, or disassemble the App
• Remove any copyright, trademark, or other proprietary notices
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the App or its systems
• Use the App to harm, harass, or violate the rights of others
• Distribute, sell, rent, or lease the App or any portion of it
• Create derivative works based on the App
• Use automated systems (bots, scripts) to interact with the App

5. User Content

5.1 Your Content

"User Content" means any data, text, photos, or other content you create, upload, or store in the App, including but not limited to:

• Events, dates, and reminders
• Memories and photos
• Bucket list items and goals
• Any other information you input into the App

5.2 Ownership

You retain all ownership rights to your User Content. We do not claim any ownership rights to your User Content.

5.3 Storage and Backup

Important: Your content is stored locally on your device. LoveKeeper does not currently provide a general export, import, or restore feature. If you enable email reminders and confirm your email, event names, dates, emoji, and reminder settings are also stored on our servers only to send reminders. This limited sync is not a backup and cannot restore your local content. Device-backup availability and coverage depend on your platform, settings, and backup provider.

5.4 Content Responsibility

You are solely responsible for your User Content. You agree that your User Content will not:

• Violate any laws or regulations
• Infringe on the intellectual property rights of others
• Contain illegal, harmful, or offensive material
• Include personal information of others without their consent

6. Data and Privacy

6.1 Local Storage

LoveKeeper stores your content locally. When email reminders are enabled and your email is confirmed, it also stores the event details needed for those reminders on our server. This means:

• We can process event names, dates, and emoji needed for email reminders; memories and photos remain local
• Your data is not synchronized across devices
• If you delete the App or reset your device, your local content may be permanently lost; LoveKeeper cannot guarantee that a device backup will include or restore it

6.2 Privacy Policy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we handle your information.

6.3 Analytics

We collect anonymized usage analytics to improve the App. This data does not include your User Content. You can opt-out of analytics in the App settings.

7. Intellectual Property

7.1 App Ownership

The App and all its original content (excluding User Content), features, and functionality are owned by LoveKeeper and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Trademarks

LoveKeeper, the LoveKeeper logo, and all related names, logos, product and service names, designs, and slogans are trademarks of LoveKeeper. You may not use these trademarks without our prior written permission.

8. Third-Party Services

The App may contain links to third-party websites or services that are not owned or controlled by LoveKeeper. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

Third-party services used by the App:

• Amplitude Analytics: For anonymized usage analytics (Amplitude Terms)
• Apple Push Notification Service / Firebase Cloud Messaging: For sending reminders (governed by Apple/Google terms)

9. Disclaimers and Limitations of Liability

9.1 "AS IS" and "AS AVAILABLE"

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The App will be error-free or uninterrupted
• Defects will be corrected
• The App is free of viruses or harmful components
• Results from using the App will be accurate or reliable

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOVEKEEPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

In particular, we are not liable for:

• Loss or corruption of your User Content
• Failure to remind you of important dates
• Missed anniversaries or birthdays
• Relationship issues arising from use or non-use of the App
• Consequences of relying on the App for critical reminders

9.3 User Responsibility

You acknowledge that:

• You are responsible for backing up your data
• You should not rely solely on the App for critical reminders
• Technology can fail, and you should have backup reminder systems
• We are not responsible for relationship advice or outcomes

10. Indemnification

You agree to defend, indemnify, and hold harmless LoveKeeper, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use or misuse of the App
• Your User Content
• Your violation of any rights of another person or entity

11. Termination

11.1 By You

You may stop using the App and uninstall it at any time. Upon uninstallation, all your User Content stored locally will be deleted.

11.2 By Us

We reserve the right to terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms.

11.3 Effect of Termination

Upon termination:

• Your right to use the App will immediately cease
• All provisions of these Terms that should survive termination shall survive (including ownership provisions, warranty disclaimers, and limitations of liability)

12. Changes to the App

We reserve the right to:

• Modify, suspend, or discontinue the App at any time
• Add or remove features
• Change the design or functionality
• Require updates to continue using the App

We will make reasonable efforts to notify you of significant changes, but we are not obligated to do so.

13. Changes to Terms

We may revise these Terms from time to time. Changes will be effective immediately upon posting the revised Terms in the App and on this website. Your continued use of the App after changes constitutes acceptance of the revised Terms.

We will update the "Last Updated" date at the top of this page when we make changes.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

14.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the App shall be resolved through:

1. Informal Negotiation: Contact us first to try to resolve the dispute informally
2. Mediation: If informal negotiation fails, we agree to attempt mediation
3. Arbitration/Court: If mediation fails, disputes may be resolved through binding arbitration or court proceedings as per applicable law

14.3 Class Action Waiver

To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and LoveKeeper regarding the App and supersede all prior agreements.

15.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign or transfer these Terms without restriction.

15.5 No Agency

No agency, partnership, joint venture, or employment relationship is created as a result of these Terms, and you do not have any authority to bind LoveKeeper in any respect.

15.6 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.

17. Apple App Store / Google Play Store

If you downloaded the App from the Apple App Store or Google Play Store, you agree that:

17.1 Apple App Store

• These Terms are between you and LoveKeeper only, not with Apple Inc.
• Apple has no obligation to provide any maintenance or support services
• Apple is not responsible for addressing any claims relating to the App
• In case of any third-party claim that the App infringes intellectual property rights, LoveKeeper, not Apple, is responsible
• Apple is a third-party beneficiary of these Terms and may enforce these Terms against you

17.2 Google Play Store

• These Terms are between you and LoveKeeper only, not with Google LLC
• Your use of the App must comply with Google Play's Terms of Service
• Google is not responsible for the App, its content, or any claims related to it

18. Acknowledgment

By using LoveKeeper, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

Remember: LoveKeeper is a tool to help you remember important dates, but it's not a substitute for genuine attention and care in your relationships. Technology can fail – always have a backup plan for the important moments! 💕
